TERMS & CONDITIONS

This is an important document that should be read carefully.  By completing the KangaHoops registration process, you acknowledge that you have read and understood these terms and conditions.

Definitions

1. In these terms and conditions
   1. “KKBC” means Kuringgai Kangaroos Basketball Club Incorporated ABN 80 140 590 070
   2. “BNSW” means Basketball NSW 
   3. “Claim” means any includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising from or in connection with any KKBC activities but does not include:
      1. a claim against the Organisation by any person expressly entitled to make a claim under a BNSW insurance policy
      2. a claim against the Organisation under any right expressly conferred by its Constitution or regulations
   4. “Clinics” means the KangaHoops event as authorised by the Organisation.
   5. “Player” means the minor participating in the KangaHoops Clinic
   6. “You” means the parent/guardian of the minor participating in the KangaHoops Clinic acting on behalf of that minor.

Risk Warning and Waiver

2. Our clinics are a recreational endeavour involving physical activity.  Sport in general may contain inherently dangerous elements, and participation assumes an element of risk.  Prior to undertaking any clinics, you must ensure that you are aware of and acknowledge these risks.
3. By completing the registration process, you acknowledge, agree and understand that participation in these clinics provided by KKBC may involve risk.  You agree and undertake any such risk voluntarily.  

Rules of Participation

4. By completing the registration process, if you are not already a member of KKBC, you agree to be bound by their Constitution, the By-Laws and the General Statutes and Internal Regulations.  You shall submit to any disciplinary measures taken against your and shall take any appeals and litigation before the authorities provided for in the relevant Constitutions and By-Laws.

Disclosure

5. You warrant that you:
   1. are and must continue to be medically and physically fit and able to undertake and participate in the Clinics;
   2. are not a danger to yourself or to the health and safety of others; and
   3. have not at any time suffered any blackout, seizure, convulsion, fainant or dizzy spells.
6. You acknowledge that you must, and you agree that you will, disclose any pre-existing medical or other condition that may affect the risk that either you or any other person will suffer injury, loss or damage.
7. You acknowledge that KKBC relies on information provided by you and that all such information is accurate and complete.
8. You agree to report any accidents, injuries, loss or damage you suffer during any Activities to KKBC before you leave any relevant venue.

Covid-19

9. You acknowledge and agree that:
   1. at the time of registration, no one in your household or any household relevant to the Player has experienced symptoms of fever, fatigue, difficulty in breathing or dry cough or exhibiting any other symptoms relating to the COVID-19 virus or any communicable disease within the last 14 days.
   2. at the time of registration, no one in your household or any household relevant to the Player has been diagnosed to be infected with the COVID-19 virus within the last 30 days.
   3. if at any time following this registration and prior to the Clinic the Player is exposed to or is diagnosed with the COVID-19 virus you will contact KKBC as soon as practicably possible
   4. KKBC may cancel your registration if it deems that that Players attendance is a reasonable risk

Release and Indemnity

10. By registering for and attending a Clinic, you to the extent permitted by law:
    1. release and will release KKBC from all Claims that you may have or may have had but for this release arising from or in connection with your participation; and
    2. release and indemnify KKBC against any Claim which may be made by you or on your behalf for or in respect of or arising out of your death whether caused by the negligence or breach of contract by KKBC to the extend permitted by law in respect of any Claim by any person:
       1. arising as a result of or in connection with your participation in the Clinics
       2. against KKBC in respect of any injury, loss or damage arising out of or in connection with your failure to comply with KKBC or the venues rules and/or directions
11. If you suffer any injury or illness, you agree that KKBC may provide evacuation, first aid and/or medical treatment at your expense and that your acceptance of these terms and conditions constitutes your consent to such evacuation, first aid and/or medical treatment

Insurance

12. You understand that insurance taken out by KKBC may not provide you with protection for loss, damage or injury that you may suffer during your participation in the Clinic.  You acknowledge and accept that you may have to pay the excess if a claim is made on your behalf.  You agree that your own insurance arrangements are ultimately your responsibility and you will arrange any additional coverage at your expense after taking into account your own circumstances.

Photography and Social Media

13. You acknowledge and consent to photographs and electronic images being taken of you during your participation in the Clinic.  You acknowledge and agree that such photographs and electronic images are owned by KKBC and that they may use these photographs or electronic images for promotion or other purposes without consent if you have not indicated otherwise on the registration form.

Privacy

14. KKBC acknowledges and respects your privacy. Information collected is for the purpose of communicating details and future offers and events with you.  The information collected will not be shared with any third parties.
